Introduction

This Public Wifi Terms of Use Policy (Policy) should be read in conjunction with Our General Terms, made available via www.ribbyhall.co.uk/legal and details the specific terms on which you may make use of Our public wifi service (Service).  PLEASE HAVE SPECIAL REGARD TO THE GENERAL TERMS.

Terms shall take the meanings given to them in the General Terms unless otherwise defined in this Policy.

It is important that upon entering into a Contract with Us, you retain a copy of the General Terms and this Policy at that time for future reference as We do not necessarily retain a record.  Please read the General Terms and this Policy carefully prior to making use of the Service.  We recommend that you print a copy for future reference.

By logging in to use the Service, you confirm that you accept the terms of this Policy and that you agree to comply with them.  If you do not agree to this Policy, you must not make use of the Services. 

We may amend the General Terms and this Policy from time to time without notice to you and by uploading the most recent version to the Platforms and Our Website.  This Policy was last updated on 23rd May 2018.

 
1        Extent of the Service
 

1.1       You may use this Service to access public web pages, web based email and such other online services as made available through or accessed via the Service by Us from time to time (Online Services).
 

1.2       We do not recommend in particular the use of any Online Services and your use of Online Services is carried out entirely at your own risk.  We may provide you with any usernames, passwords or access codes (Codes) as are required in order to make use of the Service and you agree and acknowledge to treat such Codes as confidential and not to disclose the Codes to any third party unless We otherwise permit you to do so.  You shall be liable for any loss or damage arising out of the disclosure of the Codes to any third party in breach of this clause.
 
1.3       We reserve the right and at Our absolute discretion, at any time to:
 

(a)   temporarily suspend the Service for operational maintenance, improvement, bug or error fixes, or for the purpose of ensuring network security. We will aim to restore the Service as soon as reasonably practical but make no warranties, representations or assurances as to when this may be achieved. For the avoidance of doubt, in such circumstances time shall not be of the essence for restoring the Service to its full functionality in the event of any temporary unavailability or impaired functionality;
(b)   restrict, limit or impose conditions on your access to certain Online Services;
(c)   change or disable the Codes or other security information necessary to use the Service and/or access the Online Services;
(d)   issue instructions to you from time to time which We believe are necessary for reasons including but not limited to health, safety, security or the quality of the Service;
(e)   examine the use to which you put the Service or the nature of the information which you send or receive when using the Service;
(f)    withdraw your access to any Online Services;
(g)   cease to provide the Service or change the specifications or manner of use of the Service.
 

1.4       We shall not be held responsible for any loss, damage or inconvenience you may suffer as a result of you not being able to access the Service or for loss of access to the Service during use.
 

1.5       Whilst We take reasonable steps to ensure the security of the Service and to prevent unlawful access to information transmitted or received using the Service We have no responsibility for, nor have any control over the Online Services and cannot guarantee the safety or security of the information which you may transmit or receive using the Service or located on any equipment utilising the Service and you accept that it is your responsibility to protect your information and have adequate security (in terms of equipment and procedures) to ensure the safety, security, integrity and confidentiality of your information and data. We do not endorse any such Online Services or guarantee that it is free from any error, virus, worm, Trojan horse or other harmful code from time to time. We do not provide you with any kind of anti-malware and you are therefore responsible for ensuring your own equipment has the necessary anti-malware software installed.
 

1.6       If you have a problem using the Service please email enquiries@ribbyhall.co.uk and We will take reasonable steps to resolve any problems with the Service.
 

2           Access to the Service
 

2.1       To access the Service you may be required to log in with an email address and an access code. Where applicable you agree and acknowledge that access codes and other log in related information is confidential and you will not disclose them to any third party.
 

2.2       Access to the Service is for your use only and you are not permitted to re-sell the Service to any third party for money or money’s worth or otherwise provide use of the Service.
 

3           Limitations on Use
 

3.1       We do not guarantee:
 

(a)   the accessibility of any or all elements of the Service or the Online Services including but not limited to any particular websites. Some services and programs may not work when using the Service;
(b)   the availability or error-free nature of the Service in general, in particular the Service may be unavailable during periods when We are implementing upgrades to or carrying out essential maintenance to Our IT equipment or systems;
(c)   the speed at which information may be transmitted or received via the Service;
(d)   that you shall be assigned the same (or similar) Internet Protocol (IP) addresses between separate sessions whilst using the Service; or
(e)   that the Service will be compatible with your equipment or any software which you use.
 
3.2       We reserve the right to restrict your access to the Service and at present usage is limited to 0.5MB per device. Furthermore, usage of the public network is limited to email, web browsing and social media only and you may therefore find that in your use of the Service certain Internet Services are restricted.
 

4           Acceptable Use of the Service
 

4.1       You must ensure that the equipment you use to connect to the Service is used in accordance with these Terms and any applicable legislation, regulation and relevant law. Equipment you use should be used in accordance with any instructions and safety procedures applicable to the use of the equipment.
 

4.2       Equipment that you use should not in Our reasonable opinion:
 

(a)   be defective or illegal;

(b)   cause any technical or other problems to the Service;

(c)   adversely interfere with the Service; and

(d)   be harmful to other Users of the Service.

 

4.3       Anti-malware software provides an element of protection and you warrant that your equipment has anti-malware software when using the Service. Spreading of viruses is prohibited under The Computer Misuse Act 1990.
 

4.4       In accordance with the Copyright, Designs and Patents Act 1988 (CDPA), any content (including but not limited to software, documents, pictures, video and music) accessible via the Online Services are copyright works and you should not use such content in any way which would constitute a breach of intellectual property rights under the CDPA or other applicable law.
 

4.5       You must not use the Service for any purpose that is unlawful, prohibited by law, regulation or legislation and in particular (but not limited to) use any Online Services which:
 

(a)   are fraudulent, defamatory, threatening, intimidatory or which could be classed as harassment, stalking or otherwise violating the rights of others, including without limitation others’ privacy rights or rights of publicity;

(b)   would violate the security of the Service such as (but not limited to) hacking, cracking into, decompiling, monitoring, or using systems without authorisation.

(c)   engage in online gambling;

(d)   contain obscene, profane or abusive language or material;

(e)   contain pornographic material (that is text, pictures, films, video clips of a sexual explicit or arousing nature);

(f)    contain offensive or derogatory images regarding sex, race, religion, colour, origin, age, physical or mental disability, medical condition, sexual orientation or such other attribute as We from time to time may determine;

(g)   is for the purpose of harming or attempting to harm minors in any way, which shall for the avoidance of doubt preclude you from downloading, printing or otherwise making copies of any photographs of minors;

(h)   contain material which infringe a third party’s rights (including intellectual property rights);

(i)     impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity, or express or imply that We endorse any statement you make;

(j)     in any way adversely affects the manner in which We carry out Our business including in any way interfering with or disrupting the operation of the Services, Our servers or networks used to make the Services available;

(k)   transmits or otherwise makes available in connection with the Services any virus, worm, Trojan horse or other computer code that is harmful or invasive or may or is intended to damage the operation of, or to monitor the use of, any hardware, software or equipment; or

(l)     are otherwise unlawful or inappropriate.

 
5           Criminal Activity
 

5.1       You must not use the Service in any way that would constitute or may constitute a criminal offence, either in the United Kingdom or in any jurisdiction throughout the world.
 

5.2       You agree and acknowledge that We may be required to provide assistance and information to law enforcement, government agencies or other authorities and you further agree that We are entitled to co-operate with law enforcement authorities in any investigation of suspected or alleged illegal activity by you. you agree and acknowledge that such co-operation may include, but not be limited to, disclosure of such information as We have (including but not limited to your personal information).
 

5.3       You agree that We may keep a log of the IP addresses of any devices that use the Service and the times of access and activity associated with that IP address.
 

6           Termination & Suspension
 

6.1       We reserve the right to terminate or temporarily suspend your access to the Service immediately at any time and for any reason, (without limitation) in the event of:
 

(a)   a breach (or anticipated breach) of these Terms by you or any other third party end user making use of the Service through you (whether or not you are aware of such third party use);
(b)   an emergency or for operational maintenance or improvements or for the purpose of ensuring network or information.
